BreathOS Terms of Service

1. Introduction

These terms govern your use of BreathOS, a breathing-practice app for iPhone. They form an agreement between you and BreathOS, the app's publisher ("we," "us"). Please read them before using the app.

The short version: BreathOS is a wellness app, not medical care. Premium is a single payment with no subscription, and it includes future updates to this app. Your data stays on your device. See the Privacy Policy for how that works.

By downloading or using BreathOS, you agree to these terms. If you do not agree, please delete the app and discontinue use.

You must be 13 or older to use BreathOS, matching the app's App Store age rating. Breathing practices carry physical risk, so please read section 6 and follow the guidance there before using the app. If you are under 18, use BreathOS with a parent or guardian's knowledge.

2. Relationship to Apple's terms

BreathOS is distributed through the Apple App Store, and Apple's own terms apply to your download and purchase alongside these terms. Where these terms and Apple's Licensed Application End User License Agreement conflict on a matter Apple governs, such as delivery, payment, or refunds, Apple's terms control.

Apple is not a party to this agreement and has no responsibility for the app or its content. Apple is, however, a third-party beneficiary of these terms and may enforce them against you. Apple has no obligation to provide support or maintenance for BreathOS.

3. License to use BreathOS

We grant you a personal, non-exclusive, non-transferable license to use BreathOS on Apple devices you own or control, as permitted by Apple's App Store terms.

You may not sell, rent, sublicense, or redistribute the app; reverse-engineer, decompile, or attempt to derive its source code, except where that restriction is prohibited by law; or extract its audio, visual, or written content for use outside the app.

4. Premium

BreathOS is free to download and use. A one-time purchase unlocks premium features, including the custom pattern builder and the full library of animations, soundscapes, themes, and customization controls.

This purchase is a one-time payment, not a subscription. There is no recurring charge and nothing to cancel.

Future updates are included. New patterns, sounds, and features added to BreathOS become available to you at no additional cost. "BreathOS" here means this app, distributed under this App Store listing. If we ever release a separate product under a different App Store listing, that would be a distinct app and is not covered by this purchase.

Premium unlocks the app's features as they exist and as they develop. We do not guarantee that any particular feature will be added, kept, or preserved in its current form. Where a feature is removed, we will not remove features you have already used to create content without providing a way to keep that content usable.

Your purchase is tied to your Apple Account. You can restore it on your other devices using Restore Purchase in the app.

"Lifetime" describes the purchase, not a guarantee that BreathOS will be developed or distributed forever. We may stop releasing updates, or withdraw the app from the App Store, at any time. If that happens the app you have already installed keeps working, your patterns and history remain on your device, and you can still reinstall it from your Apple Account purchase history for as long as Apple makes that possible. We are not able to refund a past purchase; refunds are Apple's to issue (see section 5).

5. Pricing and refunds

Prices are set in App Store Connect and shown to you in the app before purchase. We may change the price of premium for new purchasers; a price change never affects a purchase you have already made.

All payments are processed by Apple. We never see your payment details.

Refunds are handled entirely by Apple under its own policies. We cannot issue, approve, or deny a refund. To request one, use Apple's process at reportaproblem.apple.com.

6. Health and safety

This is the most important section of this document. Please read it.

BreathOS is intended for general wellness. It is not a medical device, and nothing in it is medical advice, diagnosis, or treatment. Breathing exercises are not a substitute for care from a qualified professional.

Breathing practices, particularly those involving breath retention or rapid breathing, can cause dizziness, lightheadedness, tingling, or fainting. Consult a physician before using BreathOS if you are pregnant, or if you have or suspect any cardiovascular condition, respiratory condition, epilepsy or a seizure disorder, low blood pressure, or an anxiety or panic disorder.

Practice safely:

Practice seated or lying down, in a safe place where fainting would not injure you
Never practice while driving, operating machinery, or doing anything requiring your attention
Never practice in or near water. Breath retention in water can cause loss of consciousness without warning and can be fatal
Stop immediately if you feel dizzy, lightheaded, short of breath, or unwell, and breathe normally until it passes

Custom patterns are your responsibility. The pattern builder applies limits on phase durations and flags some unsafe combinations, but these limits are product judgments, not clinical standards. They cannot account for your individual health, and they do not make every pattern you can build safe for you. You are responsible for the patterns you create and practice.

If you experience a medical emergency, stop using the app and seek medical attention.

7. Your content

Patterns you create in BreathOS are yours. They are stored on your device, and we have no access to them. The app has no servers and transmits nothing.

Because your content exists only on your device, you are responsible for it. Deleting the app deletes everything it stored, and we cannot recover it.

8. Acceptable use

Use BreathOS lawfully and as intended. Do not use it to harm yourself or others, interfere with its operation or security, or circumvent premium features or the purchase process.

9. Intellectual property

BreathOS, including its name, design, animations, audio, written content, and code, is owned by us and protected by copyright and other laws. These terms grant you a license to use the app, not any ownership of it.

10. Disclaimer of warranties

BreathOS is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or iOS version, or that any health or wellness outcome will result from using it.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use BreathOS.

Our total liability for any claim relating to BreathOS will not exceed the amount you paid for the app in the twelve months before the claim.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

12. Termination

This license lasts until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the app. Sections 6, 9 through 11, 14, and 15 survive termination.

13. Changes to these terms

We may update these terms as the app changes. Material changes will be noted in the app or in the App Store release notes before they take effect. The effective date at the top of this document indicates the current version. Continuing to use BreathOS after a change takes effect means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to that jurisdiction.

This section does not deprive you of the protection of mandatory consumer-protection laws in your place of residence.

15. General

Severability. If any provision of these terms is held unenforceable, that provision is limited or removed to the minimum extent necessary and the rest remain in full force. This matters most for sections 10 and 11, where some limitations may not apply in every jurisdiction.

Entire agreement. These terms, together with the Privacy Policy and Apple's own terms, are the whole agreement between you and us about BreathOS. They replace anything said elsewhere, including in support correspondence or marketing.

No waiver. If we do not enforce a provision on one occasion, we have not given up the right to enforce it later.

Assignment. You may not transfer these terms to anyone else. We may transfer them if BreathOS is sold or otherwise changes hands, in which case the new owner takes on these same obligations to you.

California consumers. Under California Civil Code section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
